Welcome to our social media app, where questions and polls drive the conversation! These terms of service (the "Terms") govern your use of our app and the services, features, content, and applications offered by Opingo (together with our affiliates, "we," "us," or "our").

Please read these Terms carefully before using our app. By accessing or using our app, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms, do not use our app.

Use of our app: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our app for your personal, non-commercial use. You may not use our app or the content and materials on our app for any commercial purpose or in any way that is unlawful, or harms us or any other person or entity, as determined in our sole discretion.

User Content: You are responsible for the content that you post on or through our app, including any questions, polls, media, or other materials (collectively, "User Content"). You may not post any User Content that is: (a) illegal, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, or otherwise offensive or inappropriate; (b) racist, sexist, homophobic, transphobic, or discriminatory; (c) spam or unsolicited commercial messages; or (d) infringes on the intellectual property rights of others. We reserve the right, but have no obligation, to monitor, remove, or edit any User Content that we determine in our sole discretion to be in violation of these terms or otherwise inappropriate. You agree to our use of automated systems to filter objectionable content and our right to remove or disable access to any content that violates these terms.

Reporting and Blocking: Our app provides mechanisms for users to report offensive content and block abusive users. Reports will be reviewed, and necessary actions will be taken within 24 hours. Users can block others to prevent any interactions from them.

No Tolerance for Objectionable Content and Abusive Users: We have a zero-tolerance policy for objectionable content and abusive behavior. You agree not to post, share, or engage in any content or behavior that is illegal, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, or otherwise offensive or inappropriate. This includes, but is not limited to, content or behavior that is:

• Racist, sexist, homophobic, transphobic, or discriminatory against any individual or group.
• Spam or unsolicited commercial messages.
• Infringing on the intellectual property rights of others.
• Promoting violence, self-harm, or any other dangerous activities.
• Designed to provoke, antagonize, harass, harm, scare, distress, embarrass, or upset people.

Any violation of this policy will result in immediate action, including but not limited to, removal of the content, suspension, or termination of your account. We reserve the right to act on reports of objectionable content or abusive behavior within 24 hours and will take appropriate measures to ensure a safe and respectful environment for all users.
By using our app, you agree to adhere to these guidelines and understand that failure to comply may result in consequences including removal of your content and termination of your access to our services.

Intellectual property rights: Our app and the content and materials on our app, including without limitation, text, graphics, logos, images, and software, are the property of Opingo or our licensors and are protected by copyright and other intellectual property laws. You may not use any content or materials on our app for any commercial purpose without the express written consent of Opingo.

Disclaimer of Warranties: Our app is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of our app or the information, content, materials, or products included in our app. We do not warrant that our app will be uninterrupted or error-free, and we will not be liable for any interruptions or errors.

Limitation of liability: We will not be liable for any damages of any kind arising from the use of our app, including without limitation, direct, indirect, incidental, punitive, and consequential damages.

Indemnification: You agree to indemnify and hold Opingo and our affiliates, officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of our app, your violation of these Terms, or your violation of any rights of another.

Termination: We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of our app, without notice, for any reason, including without limitation, breach of these Terms.

Governing law: These Terms and your use of our app will be governed by and construed in accordance with the laws of the State of Delaware and the federal laws of the United States, without giving effect to any principles of conflicts of law.

Changes to these Terms: We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms at any time. Please check these Terms periodically for changes. Your continued use of our app following the posting of changes to these Terms will mean that you accept and agree to the changes.

Dispute resolution: Any dispute arising out of or relating to these Terms or the use of our app will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in the state of Delaware.

Entire agreement: These Terms constitute the entire agreement between you and Opingo regarding the use of our app. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

In-app purchases: Some features of our app may be available for purchase through in-app transactions. These transactions are governed by the payment and billing policies of the platform on which our app is distributed (e.g., the App Store or Google Play). We are not responsible for any issues related to the processing or fulfillment of in-app purchases.

Termination of service: We reserve the right to modify, suspend, or terminate the operation of our app or any part of it, at any time, for any reason, and without notice. We will not be liable to you or any third party for any modification, suspension, or termination of our app or any part of it.

Feedback: We welcome your feedback, comments, and suggestions regarding our app. However, by submitting any feedback, comments, or suggestions to us, you acknowledge and agree that we are free to use, disclose, reproduce, modify, license, transfer, and exploit such feedback, comments, or suggestions for any purpose without any obligation or compensation to you.

Waiver and Severability: The failure of Opingo to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.
